General Exclusions

These general exclusions apply to every section of the Policy and Certificate. Therefore please read the General Exclusions, as they restrict the circumstances in which a Benefit may be payable.

The Policy does not cover any event which either in origin or extent, directly or indirectly, proximately or remotely, is to be attributed to or is a consequence of:

  1. War, hostilities or warlike operations (whether war be declared or not);
  2. Invasion;
  3. Act of an enemy foreign to the nationality of the Insured Person or the country in, or over, which the act occurs;
  4. Civil war;
  5. Riot;
  6. Rebellion;
  7. Insurrection;
  8. Revolution;
  9. Overthrow of the legally constituted government;
  10. Civil commotion assuming the proportions of, or amounting to, an uprising;
  11. Military or usurped power;
  12. Explosions of war weapons;
  13. Utilization of nuclear, chemical or biological weapons of mass destruction howsoever these may be distributed or combined;
  14. Murder or assault subsequently proved beyond reasonable doubt to have been the act of agents of a state foreign to the nationality of the Insured Person whether war be declared with that state or not;
  15. Terrorist activity;

For the purpose of this exclusion:

  1. Terrorist activity means an act, or acts, of any person, or group(s) of persons, committed for political, religious, ideological or similar purposes with the intention to influence any government and/or to put the public, or any section of the public, in fear. Terrorist activity can include, but not be limited to, the actual use of force or violence and/or the threat of such use. Furthermore, the perpetrators of terrorist activity can either be acting alone, or on behalf of, or in connection with any organization(s) or governments(s).
  2. Utilization of nuclear weapons of mass destruction means the use of any explosive nuclear weapon or device or the emission, discharge, dispersal, release or escape of fissile material emitting a level of radioactivity capable of causing incapacitating disablement or death amongst people or animals.
  3. Utilization of chemical weapons of mass destruction means the emission, discharge, dispersal, release or escape of any solid, liquid or gaseous chemical compound which, when suitably distributed, is capable of causing incapacitating disablement or death amongst people or animals.
  4. Utilization of biological weapons of mass destruction means the emission, discharge, dispersal, release or escape of any pathogenic (disease producing) micro-organism(s) and/or biologically produced toxin(s) (including genetically modified organisms and chemically synthesized toxins) which are capable of causing incapacitating disablement or death amongst people or animals.
    Also excluded hereon is any loss or expense of whatsoever nature directly or indirectly arising out of, contributed to, caused by, resulting from, or in connection with any action taken in controlling, preventing, or suppressing any, or all, of (1) to (15) above.
  5. Lonising radiation or contamination by radioactivity from any nuclear waste, from the combustion of nuclear fuel, or the radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component thereof;
  6. Active service in any of the armed forces of any nation or international agency;
  7. Any psychiatric, mental or nervous illness or disorder (including anxiety and/or depression) from which the Insured Person suffered symptoms or sought medical or psychiatric advice prior to departure from the Country of Origin;
  8. The Insured Person's intoxication (alcohol or drugs);
  9. Suicide or attempted suicide and self-inflicted injuries (whether sane or insane);
  10. Involvement in willful exposure to needless peril;
  11. Venereal diseases and sexually transmissible conditions;
  12. HIV (Human Immunodeficiency Virus) and/or any HIV related illness including AIDS (Acquired Immune Deficiency Syndrome) and/or any mutant derivatives or variations thereof however caused;
  13. Provoked assault, fighting (except in bona fide self-defense), commission or attempting to commit a felony or engagement in an illegal occupation;
  14. Aviation or participation in any other aerial activities other than travel as a fare-paying passenger on a scheduled, commercial or scheduled charter flight; or
  15. Taking part in any of the following activities:
    • Hazardous Sports;
    • Dangerous Sports;
    • engaging in professional, club, interscholastic, intercollegiate or competitive sporting event; or
    • the driving of any two- or three-wheeled motorized vehicle, or any motorized vehicle used primarily for recreational use and not for general transportation
  16. Any pre-existing physical defect, infirmity, Sickness, disease or condition in the case that this was known to the Insured Person at the time of effecting the Coverage. In some plans, this proviso is waived after 12 months of continuous coverage:
  17. A medical condition in relation to which the Insured Person has received treatment in the 12 months prior to effecting the Certificate. In some plans, this proviso is waived after 12 months of continuous coverage:

Also, no Benefits are payable:

  1. If a claim results from circumstances which reasonably could have been anticipated by the Insured Person or any other person at the date of issue of the Certificate;
  2. For Sickness or Accident of a person over 65 years of age.
  3. If there is any insurance or other financial vehicle designed for reimbursement covering the same loss, damage or any part thereof. In such case this insurance will not be liable for the risks paid or covered by such other insurance or other financial vehicle designed for reimbursement.
  4. Medical expenses and/or air ambulance, transportation costs, extra traveling expenses, as a result of any pre-existing physical defect, infirmity, Sickness, disease or affliction, are not covered when:
    • It was to be expected at the time of effecting the insurance that the medical expenses may/could/would be incurred during the Period of Insurance;
    • The Insured Person was already under medical treatment at the time of effecting the insurance and that it is necessary to continue with the treatment during the Period of Insurance;
    • The Insured Person travels against the advice of a Physician:
    • The Insured Person travels to obtain medical treatment;
    • The Insured Person is undergoing, or is on a waiting list for a course of medical treatment;
    • The Insured Person has received a terminal prognosis;
    • A claim relates to a medical condition for which the Insured Person has received treatment in or during the 12 months prior to effecting coverage under the Certificate.
